O R D E R
Heard Ms. Anita Bafna, learned counsel appearing for the
petitioner (wife). Also heard Mr. Rajiv Ranjan Dwivedi, learned
counsel appearing for the respondent (husband).
2. The mediation proved to be unsuccessful and accordingly
the Transfer Petition is taken up for consideration.
3. The petitioner with her four year old son is residing in
her parental home at Thane. It is submitted by the
petitioner’s counsel that the case filed by her under, the
Protection of Women from Domestic Violence Act, 2005 against
the husband and in-laws, is also pending before the Court at
Kalyan, District Thane. However, this information is not
available with the learned counsel for the respondent.
4. Having considered the circumstances here, we deem it
appropriate to order transfer of the HMA Case No 1226 of 2023
titled “Deepak Kumar Deshbandhu Vs Garima, pending before the
Principal Judge, Family Court, North-East Karkardooma Court,
Delhi to the competent Family Court at Kalyan, District Thane,
Maharashtra. It is ordered accordingly.
