Leave granted.
2. Being aggrieved by the judgment dated 22.02.2022 passed by the
High Court of Judicature at Allahabad in First Appeal from Order
No. 264 of 2018, the present civil appeal has been filed by the
appellants/claimants.
3. Briefly stated, the facts of the case are that on 19.08.2015,
Sh. Ganpat Singh, who was the son of the appellant Nos. 1 and 2
herein, met with a fatal accident while going on a motor-cycle on
the Agra-Aligarh Highway. The motor-cycle of Sh. Ganpat Singh
collided with a Fortuner car being driven negligently by the
respondent No. 1 driver and resultantly, Sh. Ganpat Singh died on
the spot. The said Fortuner car was owned by respondent No. 2
herein and was insured with the respondent No. 3 – insurance
company. The deceased was around 27 years-old at the time of the
accident and was a teacher by profession. He is survived by his
parents, who are appellant Nos. 1 and 2 respectively, and by three

siblings, who are appellants Nos. 3, 4 and 5 herein. The deceased
was a bachelor at the time of his death and is therefore not
