O R D E R
Heard learned counsel for the parties.
It is brought to the notice of the Court that the
petitioner was placed ex parte in the Restitution of
Conjugal Rights Petition on 13.12.2019 and, ultimately,
the ex parte decree was passed on 11.01.2020 against the
petitioner.
It seems this Transfer Petition is filed with vague
facts. The petition does not disclose that the
petitioner was placed ex parte in the Restitution of
Conjugal Rights petition before the Trial Court. Be that
as it may, since the ex parte decree is already passed
and, as it is brought to the notice of this Court that
the petitioner has filed an application for restoration

of the ex parte decree before the Trial Court, I decline
to interfere in the matter.
The Transfer Petition is, accordingly, dismissed.
However, it is open for the petitioner to move the
matter again, in case the ex parte dcree is set aside.
The application for restoration may be decided at an
early date.
