1. Leave granted.
2. Heard the learned counsel for the
parties and perused the material placed before
us.
3. Considering the facts and
circumstances of the case and in order to do
complete justice to the parties, we deem it
appropriate that respondent no.1- Insurance
Company shall pay a total lumpsum amount of
Rs.10,00,000/- (Rupees ten lakhs only) to the
appellant within a period of four weeks from
today, which shall include all aspects of
interest, costs etc. and no other claim in that
aspect would be admissible at the instance of

the appellant.
4. The appeal stands allowed as above.
