O R D E R
1. Leave granted.
2. Appellant(s) challenges the judgment and order dated
25.09.2024, titled “Hazarabee and Ors vs. Imam Bee and Anr.” passed
by the High Court of Karnataka at Kalaburagi Bench in RSA No.
1580/2005.
2. Having heard learned counsel for the parties, we are of the
considered view that interest of justice would be best met with the
disposal of the present appeal on the following terms:
(i) The impugned order dated 25.09.2024 is quashed and set aside;
(ii) RSA No. 1580/2005 titled “Hazarabee and Ors vs. Imam Bee and
Anr.” is restored to its original number, position and status.
(iii) The parties shall appear before the High Court on 16.02.2026
and appeal shall be heard on its merits.
4. The Appeal stands disposed with the above terms.
5. Pending application(s), if any, shall stand disposed of.
