O R D E R

1. Applications for permission to file impleadment and

impleadment are allowed.

2. It is not in dispute that the conviction of the applicant

herein, being accused No. 1, and that of accused Nos. 2 and 3,

was confirmed by the High Court for the offences punishable

under Sections 302 and 120B of the Indian Penal Code, 1860.

Thereafter, accused Nos. 2 and 3 have been acquitted by this

Court. All other accused persons had been acquitted by the

Trial Court.

3. Considering the above, the applicant is entitled to the

benefit of the order dated 23.08.2023 passed in Criminal

Appeal No.705/2011 and Criminal Appeal No.993/2011, as he is

similarly and identically placed to the appellants in those

cases, being accused Nos. 2 and 3.

4. The order of conviction rendered against the applicant is set

aside and he is acquitted under all the charges.

5. Accordingly, IA No.70014/2024 and IA No.70016 are allowed and

the Miscellaneous Application is disposed of.

6. Pending applications, if any, shall stand disposed of.
