O R D E R

As per the earlier order dated 06.10.2023, an

inquiry has been conducted into the issue as to

whether the first respondent in this criminal

appeal is no more. This inquiry was necessitated

by the fact that the death certificate dated

02.3.2021 reflected the name of the deceased

therein differently from the name of the first

respondent, as shown in the cause-title.

Pursuant to the aforestated order, the Assistant

Commissioner of Police, Yeshwanthpura Sub-Division,

Bengaluru City, Karnataka State, conducted an inquiry

and filed affidavit dated 20.11.2023 stating that the

inquiry confirmed that ‘C. Venkatesh’ referred to in

the death certificate dated 02.3.2021 is none other

than the first respondent in the present appeal, shown

as Venkatesha @ Anta.

In that view of the matter, the criminal appeal

stands dismissed as abated insofar as respondent No.1

is concerned.

Registry is directed to list the appeal for

hearing only against respondent No.2.
