UPON hearing the counsel the court made the following O R D E R

1. The petitioners were awarded life sentence, but they were released

under the policy of the Government on Gandhi Jayanti, after serving seven

years only.

2. One of the issues apart from the merits, that arises for consideration is

whether such a policy can override the statutory provision of Section 433 A of

the Code of Criminal Procedure, 1973 which provides for the remission or

commutation of sentence only on completion of 14 years of imprisonment.
