2. Heard Mr. Rajesh Kumar Gautam, learned counsel appearing for
the Appellant(s). Also heard Mr. Zoheb Hossain, learned counsel for
the respondent (delinquent).
3. The respondent who was serving as Branch Head in Scale 1 in
the Appellant Bank faced a disciplinary proceedings and was placed
under suspension on 11.03.2014. A charge memo was issued against
him alleging multiple charges under the provisions of the United
Bank of India Officer Employees (Discipline & Appeal) Regulations,
1976 (for short “Bank Regulations”). The allegations pertained
primarily to unauthorized sanctioning of 39 Kisan Credit Card Loans
(KCC loans)
4. The inquiry report dated 24.09.2014 found that all the charges
have been proved. Eventually, the punishment of dismissal from
service was ordered by the disciplinary authority under the Bank
Regulations. Although the said decision was upheld by the
authorities within the Bank, on challenge being made by the
delinquent, the learned Single judge reached a conclusion of an
unfair inquiry and accordingly after setting aside the finding
