1. The present Transfer Petition has been filed by the

petitioner (wife) seeking transfer of Criminal Miscellaneous

Application No. 3491 of 2023, filed by respondent no.1 (mother

in law) under Section 12 of the Protection of Women from

Domestic Violence Act, 2005.

2. By filing the reply, transfer as prayed is contested

mainly on the ground that the mother in law/respondent no.1

is aged one and she may not be in a position to attend the

proceedings from Vadodara, Gujarat in the Court at Morena,

Madhya Pradesh, which is about 800 km.

3. After hearing learned counsel for the parties, we found

that the Transfer Petition (Civil) No. 119 of 2024 filed by the

petitioner(wife) seeking transfer of divorce case was allowed in

Lok Adalat by this Court by order dated 01.08.2024, as

consented by the respondent(husband). Therefore, we deem it

appropriate to direct that the case of Domestic Violence may

also be transferred to Morena, Madhya Pradesh and may be

assigned to the same Court, in case having jurisdiction or to

any other competent Court and may be taken up on one date

before the Courts, wherever they are pending.
