IN THE SUPREME COURT OF INDIA CRIMINAL APPELLATE JURISDICTION CRIMINAL APPEAL No. OF 2025 [arising out of SLP (Crl.) No. 5304 OF 2025] STATE OF UTTAR PRADESH APPELLANT VERSUS AMAN PUNSHI RESPONDENT O R D E R 1. Leave granted. 2. The State of Uttar Pradesh is in appeal challenging the order dated 14 th November, 2024 passed by the High Court of Judicature at Allahabad. 3. The respondent, who has been facing trial along with co-accused for commission of offences under Sections 302, 201 and 120-B of the Indian Penal Code, 1860, was arrested on 28 th October, 2023. 4. The order impugned notices that the respondent had applied for bail earlier before the High Court, which came to be rejected on 13 th May, 2024. 5. Close on the heels of such rejection, the respondent applied once again with success whereupon the impugned order came to be passed granting him bail for the reasons assigned therein. 6. Learned counsel appearing for the appellant-State has drawn our attention to an order dated 18 th December, 2024 passed by a coordinate Bench of this Court. While not entertaining the special leave petition filed by a co- accused-Pooja Jog, the co-ordinate Bench issued notice to the State as to why

2 the State has not challenged the order dated 14 th November, 2024, i.e., the present impugned order. 7. Be that as it may, having perused the impugned order, we find that the learned Judge has not indicated any change of circumstance since rejection of the first application for bail of the respondent by the order dated 13 th May, 2024 warranting his release on bail. That apart, the learned Judge has recorded entirely untenable reasons to support the order for grant of bail in favour of the respondent. 8. Lest any further comment prejudices the trial, we leave the matter to rest. 9. The impugned order impugned is set aside with the result that the respondent has to be taken into custody. 10. The respondent shall surrender within a fortnight from date, failing which the law shall take its own course. 11. The trial court is encouraged to expedite the trial. 12. The appeal is, accordingly, allowed on the aforesaid terms. 13. Pending application(s), if any, stand disposed of. …………….............................J.
