CORAM : HON'BLE MR. JUSTICE SURYA KANT HON'BLE MR. JUSTICE NONGMEIKAPAM KOTISWAR SINGH For Petitioner(s) : Mr. Shish Pal Laler, Adv. Mr. Ghanshyam Singh, Adv. Mr. Hitesh Kumar, Adv. Mr. Pranav Singh Gautam, Adv. Mr. hardik Gir, Adv. Mr. Rajnish Kumar Jha, AOR Mr. Mahendra Kumar, Adv. For Respondent(s) : UPON hearing the counsel the Court made the following O R D E R 1. The petitioner was elected Gram Pradhan of Village Kishanpur Jamalpur, Block and Tehsil Roorkee, District Haridwar, in the year 2022. In an election petition filed by respondent no.1, the petitioner’s election was set aside on the ground of rampant fraudulent voting as well as forgery of educational qualification documents appended along with the nomination papers. 2. The petitioner filed a revision petition before the 1 st Additional District Judge, Roorkee against her disqualification, 1
but the same was dismissed on 15.01.2025. The aggrieved petitioner has consequently approached the High Court through W.P.M.S. No.204/2025. 3. As the writ petition was not being taken up for hearing, petitioner also filed an application being I.A. No. 3/2025 praying for early hearing, which has been declined vide the impugned order. In other words, the delay in hearing of the writ petition by the High Court has prompted the petitioner to approach this Court. 4. We are informed by learned counsel for the petitioner that the writ petition is now listed for hearing before the High Court on 18.03.2025. We, therefore, request the High Court to take up the matter on the date fixed and/or any other subsequent date at the earliest, subject to other prioritized cases before the Bench. 5. Further, since there was an order of status quo in favour of the petitioner during the pendency of her revision petition before the 1 st Additional District Judge, Roorkee apart from the fact that till date she has been performing the duties of Gram Pradhan, we direct that the petitioner shall be allowed to continue to hold the office of Gram Pradhan as well as to perform the duties till W.P.M.S. No.204/2025 is decided by the High Court on merits. 6. The special leave petition is, accordingly, disposed of. 7. All pending applications, if any, also stand disposed of.
