We have heard learned counsel for the appellant and learned counsel for the respondents in these appeals at length. Without expressing any opinion on the contentions raised, we propose to dispose of these appeals as under: Since the accident occurred on 11.08.2000, the compensation shall be at Rs.4,00,000/- (Rupees Four Lakhs only). Since there has been a long lapse of time in the adjudication of the claims inasmuch as the claims were made in the year 2003 and after a long legal battle were ultimately crystallized in the year 2018, the interest shall be calculated at the rate of 9% per annum on Rs.4,00,000/- (Rupees Four Lakhs only) with effect from the date of the accident i.e., 11.08.2000 till the date of realization or deposit before the concerned Railway Claims Tribunal, Patna Bench. 1
Diary No.10240/2023 It is needless to observe that if any additional amount has to be paid by the appellant herein having regard to the aforesaid direction given by this Court, the same shall be deposited within a period of three months from today. On such deposit being made, the same shall be withdrawn proportionately as ordered by the Railway Claims Tribunal by the respondent-claimants. In addition, a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) shall be paid by the appellant to each of the respondents in both the cases towards litigation expenses having regard to the fact the respondents herein being the dependents of the deceased persons have been waiting for the compensation for a long period of time (twenty four years) and had to engage in litigation for over two decades up till this Court.
