1 IN THE SUPREME COURT OF INDIA CIVIL ORIGINAL JURISDICTION TRANSFER PETITION CIVIL NO.656 OF 2019 HEENA AFREEN PETITIONER(S) VERSUS NAZEERAHMED RESPONDENT(S) O R D E R On 04.04.2019 notice was issued in this case. The Court has recorded on 28.02.2020 that the service is complete on sole respondent but none has put in appearance on behalf of the sole respondent and therefore the case was adjourned. On 20.05.2020, the Court recorded that the respondent has not entered appearance despite completion of service and also observed that the matter will be disposed of on the next date of hearing if the respondent does not appear. Today, when the matter came up Ms. Rukhsana Choudhury, learned counsel for the petitioner has submitted that none has entered appearance. Under these circumstances, this Court has taken up the matter for hearing. Ms. Rukhsana Choudhury, learned counsel for the petitioner stated that she seeks transfer of O.S. No.33 of 2018 titled ‘ Nazeerahmed vs. Heena Afreen ’ pending before the Principal Judge, Family Court, Vijayapura at Vijayapura, Karnataka to the Principal Judge, Family Court at Solapur, Maharashtra.
2 The grounds for seeking transfer are mentioned in the petition and reiterated. Having heard the learned counsel for the petitioner, this Court of the view that the O.S. No.33 of 2018 titled “ Nazeerahmed vs. Heena Afreen” pending before the Principal Judge, Family Court, Vijayapura at Vijayapura, Karnataka needs to be transferred to the Principal Judge, Family Court at Solapur, Maharashtra. The transferor court shall forthwith transmit the record of the aforesaid case to the transferee court. The Transfer Petition stands allowed.
