From the counter affidavit filed on behalf ofrespondent No. 2, it transpires that pursuant to theimpugned order dated March 1, 2011 passed by the HighCourt, the Chief Judicial Magistrate, Mujaffarnagar,after hearing learned counsel for the accused and theA.P.P., formed an opinion that it was necessary to
order further investigation and consequently, directedthat all the papers be made available to theInvestigating Officer/S.H.O. for conducting furtherinvestigation of the present case. It appears that on 29th April, 2011, when thematter was taken up by this Court and notice wasissued, the order dated April 21, 2011 passed by theChief Judicial Magistrate, Mujaffarnagar was notbrought to its notice. Having regard to the above facts, we are satisfiedthat no interference is called for in the impugnedorder. The special leave petition is accordinglydismissed. The concerned Investigating Officer/S.H.O. isdirected to complete further investigation incompliance of the order dated April 21, 2011 passed bythe Chief Judicial Magistrate, Mujaffarnagar, if notcompleted so far, expeditiously and in no case, later 3than two months from today, and submit his report tothe concerned Magistrate.
