UPON hearing the counsel the Court made the following O R D E R While entertaining Miscellaneous Application No.1140 of 2019 preferred by applicant Arvind Kumar Singh in Criminal Appeal No.998 of 2018, this Court by its order dated 18.07.2019 recorded the statement of the learned counsel for the applicant that he would deposit a sum of Rs.27.47 Lakhs in the Registry of this Court.

2 This Court, therefore, directed said applicant to deposit a sum of Rs.10 Lakhs, whereafter the amount of Rs.10 Lakhs was deposited in the Registry of this Court. Unfortunately, Arvind Kumar Singh expired on 08.11.2019 which fact was recorded in the order dated 20.02.2020. The Registry has now put up the matter for appropriate directions with respect to the sum of Rs.10 Lakhs, which is lying in deposit in the Registry. In the circumstances, we direct as under: a) The Registry shall transmit the sum of Rs.10 Lakhs alongwith interest, if any, accrued thereon to the Registry of the Trial Court within two weeks from today; b) The Trial Court shall cause notice to be issued to the legal representative(s) of Arvind Kumar Singh; and c) After being satisfied about the status of the legal representative(s) in accordance with the applicable principles of law, the Trial Court shall disburse the sum so transmitted to the legal representative(s) after taking a bond of indemnity.
