Leave granted. 2 Challenge in the present appeal is to the order dated 1.2.2010 passed in Special Criminal Application No. 1339 of 2009 whereby the High Court dismissed the application filed by the appellant herein. 3. We have heard learned counsel appearing appearing for the parties. 4. We have gone through the impugned order. We are not satisfied with the same as it lacks the reasoning nor does it take a proper view of the matter regarding the initial maintenance granted in favour of the wife. 5. In that view, we set-aside the impugned order and remit this matter to the High Court with the request to decide it afresh on merits within six months from the date of communication of this order. Needless to say that in the : 2 : meantime, the husband shall continue to pay the maintenance to the wife as ordered by the trial court. 6.
