However, the reporthas been received that mediation has failed. Thus,

obviously the matter is to be decided on merits inaccordance with law. Wife has filed this petition under Section 25 ofthe Civil Procedure Code with the prayer for transferof M.C. No. 13 of 2011 from K.G.F. Karnataka to Kanpur(U.P.). Having gone through the same, we deem it fitand proper to transfer the matter to the Family Courtat Kanpur. The parties are directed to appear beforethe Family Court, Kanpur, on 29/11/2011 and the Courtat K.G.F. Karnataka is directed to remit the record tothe said Court forthwith. The petitioner - wife would file the writtenstatement within fifteen days from the date, she puts -2- in appearance on 29/11/2011. The Court thereafter would frame the issues and decide the suit itself as expeditiously as possible and preferably within a period of six months from the date of framing of the issues. It is also expected that none of the parties would seek undue adjournment of the matter. Copy of the order be sent to the Family court at Kanpur forthwith.
