Though the impugned order is interim in nature, we are inclined to pass an equitable order as there is a legal issue involved with respect to the application of the new Act, which is to be decided by the High Court, therefore, we are not expressing anything on merits. However, considering the fact that respondents are agitating the matter for more than two decades and are yet to see the colour of the coin, we are inclined to modify the impugned

2 order to that of 35 per cent of the total amount awarded by the trial Court, which can be permitted to be withdrawn by the respondents, without prejudice to the contentions of the appeal.
