The petitioner (husband) seeks transfer of Divorce Case bearing R.S. No.2076/2009 titled “Kanwalpreet Singh Lamba vs Simpy Gulati @ Simranpreet Kaur Lamba” filed by him under Section 13 (1) (ia) of the Hindu Marriage Act, 1955 against the respondent (wife), which is now pending before the Family Court, Lucknow, U.P. 3. The petitioner (husband) seeks transfer thereof to Tis Hazari, Family Courts (Central District), Delhi. 4. He had filed the aforesaid divorce petition before the Tis Hazari, Family Courts (Central District), Delhi but it was transferred by this Court to the Family Court at Lucknow, U.P. One of the reasons put­forth by the petitioner (husband) which is well merited is that there is an inordinate delay in deciding the divorce petition. The Divorce Petition was filed way back in the year 2009 which ought to have been decided by now by the concerned Court. We are, however, not aware as to who is responsible for causing the delay. Therefore, we decline to make any further

2 comment in this regard. It will suffice to dispose of this Transfer Petition with a direction to the Family Court at Lucknow, U.P. to allow the petitioner (husband) to appear through Video Conferencing mode to the extent possible. The Family Court is further directed to make an endeavour to decide the Divorce Case within a year from the date of receipt of a copy of this order. 5. Meanwhile, the Family Court may also explore the possibility of an amicable settlement of the matrimonial disputes between the parties through mediation. 6.
