UPON hearing the counsel the Court made the following O R D E R Heard learned counsel for the parties. We perused the reply filed by State of Jharkhand. With respect to the incumbents from serial nos.1 to 114 payment of salary has been approved and released on the different dates mentioned in the affidavit. 4

With respect to incumbents at serial no.115 to 143, it has been stated that in compliance of the order dated 24.09.2018 passed by this Court, State Government after hearing the parties has disallowed the claim vide order dated 07.12.2018 on the basis of the communication made by the college on 02.02.2018 forwarded by the University to the State Government regarding non-fulfilment of conditions as laid down by this Court. It is also pointed out that with respect to the incumbents at serial no.144 to 150 the salary has been approved and released on 07.12.2018. With respect to incumbent at serial no.151, namely, Sunil Kumar it is pointed out that University has to take the steps for fixation and for doing the needful. With respect to incumbent at serial no.152 it has been pointed out that he has left the KCB college in 1996 and had joined the service on regular basis pursuant to recommendation made by the Bihar College Service Commission. With respect to incumbent at serial no.153, 154 and 155 University has to do the needful at the first instance. In the circumstances, we dispose of Contempt Petitions which have filed by the incumbents at serial no.1 to 114 and serial no.144 to 150 and 151, namely, Anil Kumar. With respect to incumbents at serial no.152 to 155, we request the University as well as the State Government to do the needful within a period of six weeks from today. We direct the University to communicate its view within six 5

weeks and thereafter State Government to decide the same within four weeks. Contempt Petitions of remaining petitioners are kept pending. The incumbents to whom payment has been made also stands disposed of. However, with respect of remaining the same be listed in the third week of January, 2019. Reply, if any, be filed. In Contempt Petition No.887/2018, the petitioner has not been granted salary, it is ordered that the said question may be raised before appropriate forum in appropriate proceedings. With the above liberty, the contempt petition is disposed of. In Contempt Petition Nos.1742-1743/2018, we request learned counsel for the petitioner(s) to furnish copy of the petition to Shri Gopal Prasad, counsel for the State of Jharkhand and reply be filed before third week of January, 2019. Let the University pay the amount which has been received by it and also the amount payable by it in the account of the concerned individuals. We also request the State of Bihar to file a compilation indicating compliance along with case numbers and the name of the petitioner(s). Let the copies of the contempt petitions be handed over to the learned counsel appearing for the State of Bihar as well as to the learned counsel for the Universities concerned within three days from today. Mahto, Finance Officer UPON hearing the counsel the Court made the following O R D E R Permission to file the contempt petition(s) is granted. Heard learned counsel for the parties. It was submitted on behalf of the State of Jharkhand that out of 155 teachers, they have already done the needful with respect to 72 teachers. The payment with respect to them had also been released. The University has to disburse the amount to them, in case it has not been disbursed. We direct the concerned University to pay the

5 amount within a period of six weeks' from today. With respect to 42 employees, it was pointed out by the State of Jharkhand that their services were terminated in the year 1992 and they were re-instated in the year 1998. In our opinion, the period has to be counted as continuity in service. Accordingly, the financial benefit that may be available to them from the date of re-instatement has to be extended. It is assured by Mr. Vijay Hansaria, learned senior counsel appearing on behalf of State of Jharkhand, the same shall be released to the concerned University, within a period of two months from today. With respect to remaining 41 employees in Jharkhand, University has reported that the record of 29 employees is not available with it. However, final decision is required to be taken by the State Government with respect to 29 employees. Let the decision be taken, the same shall be subject to the final decision of this Court, in these matters. With respect to 8 employees, the matter is in process for release of the benefits by State Government of Jharkhand. With respect to one of the employees, it has been pointed out that, pursuant to the order passed by this Court, no affidavit has been filed and he has joined the services of University after proper selection. With regard to three employees (two from Ranchi University and one from SKM University), universities have not forwarded the relevant orders. Let the concerned University do the needful, with respect to three employees and forward the compliance and send the views to the State Government. Let the aforesaid Universities comply with the direction within one month from today. With respect to State of Bihar, it was pointed out that out of 472 candidates, 466 have been absorbed and the

6 cases of rest of the 6 candidates are under process. In the second category, out of 640 candidates, 285 have been absorbed and the salaries have been released to the University. We direct the University concerned to make the payment to the employees within six weeks from today. With respect to remaining 240 employees, Mr. Dinesh Dwivedi, learned senior counsel appearing on behalf of the State of Bihar, pointed out that the University is making the inquiry to form an opinion and to send a report to the State Government. Let the compliance by the University as well as by the State Government be made within a period of two months from today. With respect to 112 employees, the Universities have rejected the claims. Let the final decision be taken with respect to them by State Government within a period two months from today. However, same shall be subject to the final decision of this Court in these matters. It was also stated by the learned senior counsel appearing on behalf of the State of Bihar that with respect to employees whose claims have been allowed by the State Government, their current salaries as well as the arrears will be released within a period of 10 (ten) days from today, for payment to the concerned employees. Let needful be done as undertaken. Let the contemnors report the compliance case-wise, to be filed in each matter, in addition to general reply. One responsible officer of each of the State is directed to be present in the Court, on the next date of hearing. The presence of other contemnors is dispensed with for the time being. It was pointed out by the learned counsel that the requisite records has not been transmitted from Magadh University to the Patliputra University and from Bhagalpur University to the Munger University. If that be so, let

UPON hearing the counsel the Court made the following O R D E R Heard learned counsel for the parties, particularly for the State of Jharkhand, State of Bihar and that of the Universities. It is stated by Mr. Vijay Hansaria, learned senior counsel appearing on behalf of the State of Jharkhand that the entire proposal has been placed before the Cabinet for release of the current salary as well as the arrears, of the employees to whom the salary is to be paid as per the order passed by this Court. Cabinet is going to take a decision very soon and the payment is going to be made by the end of August, 2018. Let the order be complied with as assured.

4 Learned counsel appearing on behalf of the state of Bihar submitted that they are going to comply the order passed by this Court on 31.08.2017, by September 15, 2018 and undertaking is being filed to comply with the order by 15 th September, 2018. Mr. V.K. Singh, Learned counsel appearing for the Universities, submitted that as soon as they receive the current salary and the arrears, they shall be disbursing the same immediately. The statement is placed on record. We give time to the State of Bihar and State of Jharkhand to comply with the order passed by this Court on 31.08.2017 and make the payment of current salary including the arrears by 15 th September, 2018.
