UPON hearing the counsel the Court made the following O R D E R Learned counsel appearing for the petitioner states that she will handover a demand draft in the sum of Rs. 3 lacs taken in the name of respondent No. 1-Naresh Agarwal to the learned counsel appearing for the respondent No. 1. The order dated 17.05.2023 shows that though this Court was not inclined to interfere on merits, the special leave petition was kept pending to enable the petitioner to make payment in terms of the impugned orders.
2 Notwithstanding the order dated 25.07.2023, the petitioner has not paid a sum of Rs. 8 lacs and has come out with a demand draft of only Rs. 3 lacs. The petitioner shall hand over the demand draft to the counsel for the first respondent. Hence, no further indulgence deserves to be shown to the petitioner except for granting a reasonable time to the petitioner to deposit the amount payable as per the impugned orders. The special leave petition is, accordingly, dismissed. However, we grant time till 25 th January, 2024 to the petitioner to pay the amounts in terms of the impugned orders. We may note here that a copy of the order dated 25.07.2023 has not been kept on the file. The Registrar (Judicial Listing) to take note of this default. Following the order passed by this Court on 17.05.2023 expressing disinclination to entertain the Special Leave Petition challenging the conviction of the Petitioner under Section 138 of the Negotiable Instruments
2 Act 1881 , the learned counsel Ms. Aiyagari has obtained instruction from the petitioner. She submits that the total liability for the petitioner is about Rupees Thirty Four Lakhs and the petitioner is prepared to pay off his dues to the respondent provided some time can be granted by the Court. 3. The respondent is agreeable to receive the money proposed to be offered by the petitioner, if it is made payable in a time bound manner. 4. Accordingly, the petitioner to show his bona fide is directed to deposit a sum of Rupees Eight Lakhs within two weeks from today directly in the bank account of the respondent, the details of which will be furnished by Mr. Rathi today itself to Ms. Aiyagari. For the balance amount, the petitioner is granted further time. However, the entire balance amount should be paid on/or before 25 th January 2024. 5. The petitioner will file an affidavit within two weeks adhering to the time frame as above, to make the payment. 6. The Special Leave Petition be posted after three weeks.
