Heard Mr. R. Basant, the learned senior counsel appearing for the petitioner in Diary No. 10120 of 2023 and Mr. Gopal Shankarnarayanan, the learned senior counsel appearing for the petitioner in Diary No. 1532 of 2023. It is submitted that although in the complaint, fabrication of a document showing nomination in favour of the disinherited son (Rajendra J.) on the basis of a forged signature of the original trustee (R.L. Jalappa) was alleged, under the impugned order, the High Court erroneously observed that the issue of forgery can also be examined by the Civil Court. The learned senior counsel would contend that there can be a parallel civil as well as criminal proceedings on this aspect. Issue notice, returnable in six weeks.
