The Magistrate issuing process for criminal defamation is not required to consider exceptions under Section 499 IPC at the summoning stage, as such exceptions constitute defences to be pleaded and proved by the accused at trial; however, the High Court may exercise inherent jurisdiction under Section 482 CrPC to quash proceedings where the complaint, on its face, is plainly covered by an exception to Section 499 IPC, without necessitating a full trial.
