UPON hearing the counsel the Court made the following O R D E R The petitioner is an accused in a case bearing FIR No.346/2024 registered at Kotla Mubarak Pur Police Station, District South Delhi, New Delhi, for the offences punishable
2 under Sections 319(2), 318(4) & 61(2) of the Bharatiya Nyaya Sanhita, 2023. His anticipatory bail application was dismissed by the High Court under the order impugned. Being aggrieved, he approached this Court and vide order dated 28.02.2025, this Court granted interim protection to the petitioner with a direction to participate in the investigation. Heard learned senior counsel for the petitioner and the learned additional solicitor general for the respondent-State. There is nothing on record which shows that the petitioner has not participated or cooperated in the ongoing investigation. Consequently, we feel that presently the custodial interrogation of the petitioner is not required. However, we make it clear that petitioner shall cooperate with the ongoing investigation and in default, the prosecution is at liberty to apprise and approach this Court. Under these circumstances, we are of the opinion that the prayer of the petitioner is allowed and the order dated 28.02.2025 is made absolute. Accordingly, in the event of the arrest of the petitioner, the petitioner is directed to be released on bail forthwith on the usual terms and conditions to be decided by the concerned Court.
