C.A. No. 001715 - 001716 / 2022
Under the seniority-cum-merit criterion for promotion to selection posts, the senior candidate possessing the minimum requisite merit has priority, and the totality of the service record — including disciplinary penalties — is a legitimate consideration that may disadvantage a candidate with a marred record. As analysed on casestatus.in, a higher pay scale within the same feeder grade is a valid determinant of inter se seniority where expressly sanctioned by an applicable Office Memorandum. An accelerated promotion granted by way of reservation benefit does not automatically confer seniority for subsequent promotion to a selection post over a candidate who was otherwise senior.
