When a dispute exists regarding whether a document is genuine or fictitious, such a question of fact cannot be adjudicated in proceedings under Section 482 CrPC for quashing an FIR; the matter must be determined through evidence adduced at trial. As analysed on casestatus.in, the High Court's inherent jurisdiction under Section 482 is not an appropriate forum to resolve disputed questions of fact going to the root of the offence. Refusal to interfere with an FIR in such circumstances is neither improper nor warrants intervention under Article 136 of the Constitution.
