A declaration under Section 6(1) of the Land Acquisition Act, 1894 is vitiated where the Land Acquisition Collector fails to objectively apply mind to objections filed under Section 5A and mechanically adopts recommendations prepared by another, rendering the Section 5A(2) report a mere formality; consequent quashing of the Section 6 declaration also invalidates the Section 4(1) notification where the gap between both exceeds one year.
